Victoria to look into class actions and litigation funding

Victoria Government has asked its Law Reform Commission to have a close look at class actions, litigation funding and group proceedings.

The Government is concerned that successful outcomes can be unduly eroded by fees, leaving plaintiffs with virtually nothing despite successfully arguing their case.  Attorney General Martin Pakula said “It is incredibly frustrating when a person wins a case, only to walk away almost empty-handed because the money has been soaked up by unfair legal fees.”

The Law Reform Commission is to report back to Government by 30 March 2018 and the Terms of Reference are available on their website.
